End User Agreement
End User Agreement (IMPORTANT: PLEASE READ CAREFULLY)
The user of this software is
subject to the terms of the end
user agreement printed below. If
you do not agree with any of the
terms, then you should not
install or use any part of the
software or service in any way.
By signing up for SourceAnywhere
Hosted service and/or using this
product, you agree to be bound
by all the terms and conditions
of this agreement.
THE AGREEMENT
This document is a legal agreement between Dynamsoft Corporation, Canada, hereafter referred to as "Dynamsoft" and the user of the software herein referred to as "You".
Definitions
"SOFTWARE" means the software known as "Dynamsoft SourceAnywhere Hosted" and all its components, parts and documentation, which have been developed by Dynamsoft.
"SERVICE" means the services provided by Dynamsoft, including but not limited to SourceAnywhere Hosted hosting service and customer service.
Subscription
SERVICE is subscribed on a per user basis (not by concurrent users). For example, if you have three developers using Dynamsoft SourceAnywhere Hosted, you need to subscribe three users: one user for each of those three developers. Each user may install the SOFTWARE Client on multiple machines as needed and access Dynamsoft SourceAnywhere Hosted Server from multiple clients at the same time.
Dynamsoft SourceAnywhere Hosted Cache Server does not require additional license or subscription. For higher performance, it is recommended you install SourceAnywhere Hosted Cache Server on your site and let multiple users connect to the cache server.
Master Subscription Agreement
By installing or using any part of the SOFTWARE, you also agree with all the
terms in the Master Subscription Agreement, which is provided when you sign up
for the SERVICE.
Copyright
All rights, title, and
copyrights in and to the
SOFTWARE and SERVICE are owned
by Dynamsoft Corporation or its
suppliers. The SOFTWARE is
protected by copyright laws and
international treaty provisions.
The SOFTWARE is subscribed, not
sold.
Restrictions
You may not modify, reverse
engineer, decompile, disassemble
the SOFTWARE.
You may make a single copy of
the SOFTWARE for backup purposes
only.
All rights reserved, except as
expressly provided for in this
agreement.
Warranties and Disclaimers
This SOFTWARE and the accompanying files are licensed "AS IS" without warranty
of any kind either expressed or implied, including but not limited to the
implied warranties of merchantability and fitness for a particular purpose. Any
use by you of the SOFTWARE is at your own risk.
Limitation of liability. Dynamsoft Corporation's entire liability and your
exclusive remedy under this Agreement shall not exceed ten US dollars (US
$10.00).
No liability for consequential damages. Under no circumstance shall Dynamsoft
or its suppliers be reliable for any damages whatsoever arising from the using
or inability of use Dynamsoft product.
Applicable Law
This agreement shall be governed
by the laws of Canada.
